Party Gear Event Planning Company

Please read these terms and conditions carefully before using our services. By accessing our services or website, you are entering into an agreement with the company for the provision of our services. The contracting party and all guests agree to be bound by these terms and conditions.
Party Gear reserves the right to change, modify, add, or remove any portion of these terms and conditions at any time. If we revise our terms, the changes will be posted on our website.
If we change our terms during or after a contract has been signed, the new terms will not be applicable to already-signed clients until their next service. If you do not agree with our terms and conditions, please refrain from accessing our services.
 

Payment terms

• The contracting party agrees to pay 50% or more of the total invoice at the time of booking. The remaining balance must be paid one week prior to the event. Failure to pay the balance in time may result in cancellation of the contract, and the deposit will be non-refundable.
• Once the deposit and signed contract are received, our services will be confirmed and in effect.

Cancellation terms

• If the contracting party cancels the booking, the 50% deposit will be forfeited.
• However, if the cancellation is made at least one month prior to the event, the deposit will be refunded.
• Party Gear reserves the right to cancel the event one month in advance for unforeseen reasons and without liability.

Changes and Rescheduling

• Party Gear must be notified of any changes to the date, time, location, or other details affecting our services.
• There is no fee for rescheduling. However, if the new date is unavailable, Party Gear will be unable to provide services, and any payments made will not be refunded.

Photography and Cinematography Conditions

• For outdoor or private location photography or videography, the client is responsible for obtaining all necessary permissions or permits.
• Party Gear will not seek guest consent for taking photos or videos; the client must arrange this.
• Party Gear reserves the right to use all images and videos captured during the event. Clients may also use these images and videos.
• Party Gear is not obligated to provide raw footage. If requested, an additional fee applies.
• Clients may submit specific video requests, photos, or music within 1 week after the event. If not provided, Party Gear will use its own materials, and no edits will be made after delivery.
• Services are provided within a fixed timeframe. If the client exceeds this time, additional charges will apply.
• Delivery timeline: 6-8 weeks for photos, 8–10 weeks for videos. Expedited delivery is available at an additional cost.
• All media will be stored for 120 days from the delivery date. After this period, data will be permanently deleted and cannot be recovered.

Deportment

• The contracting party and guests agree to respect all terms and conditions.
• Inappropriate behavior toward Party Gear staff may result in immediate departure from the event.

Service issues

• All communication will be directed to the person who signed the contract.
• The client must also provide an emergency contact, who will only be reached for minor issues—not for payment or legal matters.
• No last-minute changes or negotiations will be accepted.

Legal Matters

• This agreement is governed by the laws of the State of Michigan.
• In the event of non-payment, Party Gear retains the right to pursue legal action.
• The client is responsible for all court fees, legal fees, and collection costs incurred by Party Gear.

Out-of-State Event & Travel Policy

• Full payment, including travel fees, is required at the time of booking for out-of-state events.
• If the event is canceled at least two weeks prior, 50% of the total invoice will be refunded.
• A 20% rescheduling fee will apply. If the new date is unavailable, services will not be provided and no refund will be issued.
